OKX US E-Sign Disclosure and Consent

Published on Oct 20, 2026

This E-Sign Disclosure and Consent ("Disclosure") applies to your use of OKX's U.S. digital asset exchange platform and, if applicable, the OKX U.S. Card (together, the "Services"). In this Disclosure, "we," "us," and "our" refer to OKX Inc and WebBank and any of the OKX Inc’s or WebBank’s affiliates, agents, independent contractors, designees, assignees or service providers. For purposes of the OKX U.S. Card, "we," "us," and "our" also refer to WebBank, the issuer of the OKX U.S. Card.

By using the Services or applying for the OKX U.S. Card, you agree to receive all required legal disclosures, notices, and communications electronically, subject to the terms of this Disclosure.

1. YOUR RIGHT TO RECEIVE PAPER RECORDS

You have the right to receive legal disclosures, notices, and communications in paper form. By consenting to this Disclosure, you agree that we may instead provide these records to you electronically. OKX operates as a digital-only platform. We do not mail paper copies of any records. If you withdraw your consent, as described in Section 3 below, your ability to use the Services may be limited or terminated.

2. COVERED RECORDS

This Disclosure covers all legally required disclosures, notices, and communications we are required to provide to you in writing in connection with the Services ("Covered Records"), including:

OKX U.S. Platform

  • Terms of Service and any updates or amendments

  • Privacy Policy and any updates or amendments

  • Account opening disclosures and notices

  • State-specific regulatory disclosures

  • Transaction records and confirmations

  • Tax documents, including IRS Forms 1099

  • Account notices, alerts, and other required communications

OKX U.S. Card (if applicable)

  • Card agreement and cardholder agreement

  • Truth in Lending Act disclosures, including rate and fee summaries

  • Periodic account statements

  • Change-in-terms notices

  • Adverse action notices

  • All other disclosures required under applicable law in connection with the OKX U.S. Card

You may withdraw your consent at any time at no charge by contacting us via the Help Center. Because OKX operates as a digital-only platform, withdrawing your consent will result in the termination of your OKX account and, if applicable, your OKX U.S. Card account. Withdrawal of consent does not affect the legal validity or enforceability of any electronic records provided prior to withdrawal.

If you withdraw your consent prior to approval of your OKX U.S. Card application, we will be unable to approve your application.

4. HOW WE PROVIDE COVERED RECORDS

We may provide Covered Records to you through any of the following methods:

  • Your registered email address

  • Your OKX account (accessible via our website or mobile application)

  • Push notifications or other electronic notification methods

It is your responsibility to review Covered Records promptly so you can take appropriate action.

5. ACCESSING YOUR RECORDS

All Covered Records are available for download and print at any time through your OKX account. We retain records for the periods required by applicable law. You may request a copy of any Covered Record by contacting us via the Help Center.

OKX does not mail physical paper copies of Covered Records.

6. KEEPING YOUR CONTACT INFORMATION CURRENT

You must keep your registered email address and contact information current at all times. You may update your contact information through your account settings or by contacting us via the Help Center. If you allow another person to access your registered email address, you accept the risk that they may view your account information.

7. SYSTEM REQUIREMENTS

To access and retain Covered Records, your device must meet the following minimum requirements:

  • Active internet connection

  • A web browser supporting 128-bit encryption (current versions of Chrome, Firefox, Microsoft Edge, or Safari are supported)

  • Ability to download, save, and print documents

  • Software capable of opening PDF files (such as Adobe Reader or equivalent)

  • A valid, active email account

To confirm your device meets these requirements, please open and save or print this [Test PDF — link TBC] before consenting. By consenting to this Disclosure, you confirm that your device meets the above requirements and that you are able to access, download, and retain electronic records.

8. SCOPE AND DURATION

Your consent applies to all Covered Records for the duration of your OKX account and, if applicable, your OKX U.S. Card account. Your consent remains in effect until your account is terminated or you withdraw consent as described in Section 3.

9. OUR RIGHT TO COMMUNICATE IN PAPER FORM

We reserve the right to provide any Covered Record in paper form at our discretion, including in circumstances such as system outages or suspected fraud. Providing a record in paper form on any occasion does not waive our right to provide records electronically in the future.

By clicking "I Agree,” “I Accept,” or other similar consent language during account registration or card application, you confirm that:

(a) you have read and agree to this Disclosure;

(b) your device meets the System Requirements set out in Section 7;

(c) you are able to access, download, and retain electronic records; and

(d) you will maintain a valid registered email address.

You understand that by consenting, you may no longer receive Covered Records in paper form by mail.
